Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Anatoli Rak ("we", "us", "Posely") regarding your use of the Posely mobile application (the "App"). By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms.

Important — please read Section 4 carefully. Posely is a screening tool, not a substitute for professional bike fitting or medical advice. Cycling involves inherent risks. You assume full responsibility for any adjustments you make to your bicycle based on the App's recommendations.

1. Eligibility

You must be at least 18 years old to create a Posely account. By using the App, you represent that you meet this requirement and that the information you provide is accurate.

2. Your account

You create a Posely account using Sign in with Apple or Sign in with Google. You are responsible for keeping your account credentials secure and for all activity on your account. Notify us immediately at getposely@gmail.com if you suspect unauthorized access.

3. The Service

Posely provides:

On-device pose analysis of cycling videos to estimate knee, hip, and back angles.
Bike fit recommendations based on standard biomechanical ranges (e.g., the Hamley-Thomas saddle height formula).
A Pain Diagnosis tool that suggests possible fit-related causes for common discomfort.
Bike sizing comparisons against a database of frame geometries.
Tools to record bike notes, maintenance, and fit history.

4. Health and safety disclaimer

Posely is a screening and educational tool. It is not a medical device, not a substitute for a professional bike fit, and not a substitute for medical advice from a qualified healthcare provider.

The App's recommendations are based on generalized biomechanical models that do not account for every individual's anatomy, injury history, or riding goals. Our pose detection has known limitations, including:

It does not analyze cleat position, foot rotation, or pedal stroke asymmetry.
It cannot detect leg-length discrepancies or other structural conditions.
It cannot replicate the pressure mapping or dynamic assessments performed by professional fitters.

By using Posely, you acknowledge and agree that:

You will consult a qualified bike fitter, physical therapist, or physician for any persistent pain, injury, or chronic condition.
You will make any physical adjustments to your bicycle gradually and conservatively, and will stop if you experience pain or instability.
You assume full responsibility for the consequences of any adjustments you make based on the App's recommendations.
Cycling carries inherent risks of injury. The App does not assess your bicycle's mechanical condition, the safety of your riding environment, or your fitness to ride.

5. Acceptable use

You agree not to:

Reverse engineer, decompile, or attempt to extract the source code of the App.
Use the App to violate any law or third-party right.
Attempt to gain unauthorized access to our systems or other users' accounts.
Resell, redistribute, or commercially exploit the App or its content.
Submit videos containing other people without their consent.

6. Premium purchases

Posely offers a one-time in-app purchase ("Posely Premium") that unlocks additional features such as Pain Diagnosis, PDF export, and Find My Size. The current price is displayed in the App at the time of purchase and is processed by Apple through the App Store.

One-time payment. Posely Premium is a one-time purchase, not a subscription. There are no recurring charges.
Lifetime access. Once purchased, premium features remain available on accounts using the same Apple ID, subject to Apple's terms.
Restoring purchases. If you reinstall the App or change devices, use the "Restore Purchases" option in Settings → Account.
Refunds. Refund requests are handled by Apple per the App Store refund policy. We are not able to issue refunds directly.

7. Intellectual property

The App, including its code, design, logo, text, and recommendations engine, is owned by Anatoli Rak and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes, in accordance with these Terms and the Apple App Store Terms of Service.

You retain ownership of any content you create within the App (notes, profile data, videos). You grant us a limited license to process this content solely to provide the Service, as described in our Privacy Policy.

8. Termination

You may stop using Posely and delete your account at any time through Settings → Account → Delete Account. We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a security risk. Sections that should survive termination (such as the disclaimers, intellectual property terms, and limitation of liability) will continue to apply.

9. Disclaimer of warranties

The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation. We do not warrant that the App will be error-free, secure, or that recommendations will produce any particular outcome.

10. Limitation of liability

To the fullest extent permitted by law, in no event shall Anatoli Rak, our affiliates, or our licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation damages for personal injury, lost profits, lost data, or loss of goodwill, arising out of or related to your use of the App. Our total cumulative liability for any claim shall not exceed the amount you paid for Posely Premium in the twelve months preceding the claim, or fifty US dollars ($50), whichever is greater.

Some jurisdictions do not allow exclusion of certain warranties or limitations on certain damages. In such cases, the above exclusions and limitations will apply only to the extent permitted by applicable law.

11. Indemnification

You agree to indemnify and hold harmless Anatoli Rak from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the App, or your infringement of any third party's rights.

12. Apple-specific terms

The following terms apply if you obtained the App through the Apple App Store:

These Terms are between you and Anatoli Rak, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
Anatoli Rak, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, regulatory claims, and intellectual property claims.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Governing law

These Terms are governed by the laws applicable in the place of residence of Anatoli Rak, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of competent jurisdiction in that location, unless mandatory consumer-protection laws of your country require otherwise.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the App and reflected in the "Last updated" date above. Continued use after changes means you accept the updated Terms.
